Irvine DUI Attorney

Mr. Simons has history with the Irvine Police Department!  In the landmark case of Nelson v. City of Irvine he filed a Federal Civil Rights case against the Irvine Police for systematically denying arrestees in DUI cases the choice of a breath test instead of a blood test.  This case went to the United States Supreme Court!   (He won)

Thanks to the Law Office of Barry T. Simons, it’s never been easier to locate an Irvine DUI lawyer who can work with you. We have decades of experience with DUI cases involving the Irvine Police Department and we know how to put together a winning defense. The secret to our success lies in our thoroughness—we will look at every angle while analyzing your case, taking into account every legal and scientific consideration.   We’ll make sure you have strong representation throughout your entire case. We’ll do everything in our power to help you keep your license.  Many people do not realize that road sobriety testing is prone to error. In fact, a number of recent studies have confirmed this. Calling on our extensive knowledge of sobriety testing, we will question the effectiveness of your sobriety test as part of your defense. We will help you get a fair hearing before the Department of Motor Vehicles and in Court, so you won’t be victimized by the subjective impressions of an inadequately trained police officer.

Discovery Items

Irvine Police Department has Patrol Videos and Jail Videos.  We subpoena these tapes and thoroughly review them to determine if the Irvine Police Officer who was responsible for the arrest have the right to pull you over.  If there was no valid legal justification for the stop, all evidence obtained as a result is not admissible in Court which usually means the case is dismissed.  We further review these tapes to determine whether the officer properly conducted the field sobriety tests.  We have the  materials that were used in training the Officers and know how to challenge the way they conducted and scored the tests.  If you consented to a blood tests or were compelled by warrant to give blood we will review whether the Officer properly advised you of your rights and obligations under the Implied Consent Law.
